Yacht Clubs Require More
Than Standard Insurance
In the
clubhouse, on the docks, and on the water, your yacht club is a place where the
traditions of boating are celebrated. Though different from any other in style
and temperament, your club shares a common mission of providing its members safe
access to the joys of the water. Yet your club may unwittingly be putting its
members’ assets at risk by failing to obtain insurance specific to the unique
perils yacht clubs face.
For
example, how far off shore will your current policy take you? How accurately
will you be able to replace historic assets that are lost or damaged? If your
club serves alcohol, are you protected there? Most insurance plans simply don't
meet the special needs of yacht clubs.
The
right insurance program addresses the sporting, business, social, historic and
personal aspects of your club. When done properly, a customized policy is
developed for your club, by a qualified insurance professional, incorporating
special types of protection unique to yacht clubs:
-
A
Package Policy that covers buildings, contents and docks as well as general
liability
-
A
Marine Policy covering club-owned boats and any borrowed or chartered boat
under 85 feet used for club events
-
A
Workers Compensation Policy covering injured employees and volunteers
-
An
Auto Liability Policy for club-owned vehicles
-
An
Umbrella Policy for excess liability
-
A
Directors and Officers Policy protecting all club executives from personal
liability
-
A
Regatta Liability Policy protecting against
potential lawsuits for bodily injury and/or property damage which occurs on
the water during races, regattas, or cruises.
US
SAILING endorses the Burgee Program™ which is offered by yacht
club insurance specialists at Gowrie Barden & Brett and underwritten by the
Chubb Group of Insurance Companies. The program offers the above noted
protections and a number of very important enhancements including:
-
Building ordinance and law coverage for building code changes after a loss
-
Debris removal for direct damage loss
-
Jones Act coverage for employees working on the water
-
Coverage of club members, employees and volunteers at no additional premium
-
Liquor liability
-
Coverage for claims alleging sexual molestation
-
Sailing instruction liability
-
Worldwide navigation at no additional premium
-
Pollution coverage (sudden and accidental)
-
Fuel spill liability
-
Liability from discrimination claims
These
features are not found in standard commercial and marine insurance forms, but
are the hallmark of the Burgee Program™. As yachtsmen and club members, the
specialists at Gowrie Barden & Brett have a unique understanding of the
liabilities that club officers and members face.
For
most yacht club participants, boating is a way of life. The risks that accompany
it shouldn't inhibit us from carrying on the challenges and tradition that
define our clubs.

JUNIOR SAILING PROGRAMS-Protect Your Sailors and
Instructors
Junior
Sailing programs are the spawning grounds for the future; but they are also an
area of particular concern for those responsible for protecting a yacht club’s
assets and interests. What protection is available for non-member children?
How does your insurance policy respond to an accident that occurs while your
sailing team is traveling to represent your club at a regatta or to an injured
instructor suing you under the Federal Jones Act? The Burgee Program™ begins with a thorough assessment of your
club’s activities. Then together we craft a broad insurance program that meets
your club’s special requirements.
Let’s
take a look at the above scenarios in light of typical insurance protection.
The non-member children who are participating in a sailing program are generally
not defined as “named insureds” on an insurance policy, leaving them and the
club without the same protections that exist for club members. In the situation
where a parent volunteer is en route to a regatta with a carload of kids and is
involved in an accident, questions can arise again as to just who is a “named
insured”. In today’s litigious environment, no club can afford a possible hole
in their insurance protection.
US
SAILING endorses an insurance program specifically for yacht clubs. The Burgee
Program™ is offered by yacht club insurance specialists at Gowrie Barden & Brett
and underwritten by the Chubb Group of Insurance Companies. The program offers
protection in the above scenarios by including non-member junior sailors and
volunteers as named insureds. The program also provides Federal Maritime (Jones
Act) protection for employees including sailing instructors who work on the
water – another feature missing from much typical insurance protection. The
Burgee Program™ also offers a number of very important coverage enhancements
including:
-
Building ordinance and law coverage for building code changes after a loss
-
Debris removal for direct damage loss
-
Jones Act coverage for employees working on the water
-
Coverage of club members, employees and volunteers at no additional premium
-
Liquor liability
-
Coverage for claims alleging sexual molestation
-
Sailing instruction liability
-
Worldwide navigation at no additional premium
-
Pollution coverage (sudden and accidental)
-
Fuel
spill liability
-
Liability from discrimination claims
These features are not found in standard commercial and marine insurance
forms, but are the hallmark of the Burgee Program™. The Gowrie, Barden &
Brett team of experts are sailors and club members themselves. They
understand the way clubs operate and the services they provide their members.
This has been essential to the development of the Burgee Program™.
For
many yacht clubs, a robust junior sailing program is a key component of the
club’s mission. The risks that accompany junior sailing shouldn't inhibit us
from carrying on the challenges and tradition that define our yacht clubs. The
right protection makes all the difference.
You are invited to discuss your club’s insurance situation with very
knowledgeable marine related specialists. Contact a Gowrie US SAILING

Regatta Liability: Things Happen in the Height of
Competition
At
first the fair weather clouds are fleecy white, but then the wind increases and
in minutes the water turns frothy with whitecaps and wind-driven spray. The
Race Committee sounds the warning and hoists the abandonment signal. Not all
the boats come back intact. A regatta participant is hit by a spar and
critically injured. A million dollar lawsuit is filed naming the club.
Are you covered for this
type of incident on your home waters? What about other locations whether you
are the host or just a participating club? The answer depends on the insurance
you carry and whether the club has obtained regatta liability protection.
Regatta Liability insurance specifically protects
against potential lawsuits for bodily injury and/or property damage, which
occurs on the water during races, regattas, or cruises.
US
SAILING endorses Regatta Liability protection through The Burgee Program™, which
is offered exclusively by the yacht club insurance specialists at Gowrie Barden
& Brett and underwritten by the Chubb Group of Insurance Companies. The policy protects club members, employees, volunteers, race
organizers and the club itself both for Bodily Injury and Property Damage
lawsuits and covers claims arising anywhere on the water during regattas, races,
and cruises.
For
many yacht clubs, competitive sailing is a key component of the club’s mission.
The risks that accompany regattas and cruises shouldn't inhibit us from carrying
on the challenges and traditions that define our yacht clubs. The right
protection makes all the difference.

Liquor Need not Put the Club at Risk
Your
club serves alcoholic beverages in the dining room, at barbecues, in the bar, or
maybe only occasionally allows a beer keg at a regatta or social event. No
matter how limited the context of alcohol at your club, it only takes one
member, guest or visitor leaving the club or event intoxicated to put the club’s
assets at risk. Consider the guest who overindulged after the regatta and was
involved in an accident on his way home. The result was a million dollar
lawsuit against the club that had provided him beer.
Does
your current insurance program provide liquor liability protection? Many do
not. Did you know that offering training programs for staff serving alcohol can
reduce your insurance premiums? US SAILING endorses insurance protection called
the Burgee Program™, which is offered exclusively by yacht club insurance
specialists at Gowrie Barden & Brett and underwritten by the Chubb Group of
Insurance Companies.
The
program offers liquor liability protection and a number of very important
enhancements including:
-
Building ordinance and law coverage for building code changes after a loss
-
Debris removal for direct damage loss
-
Jones Act coverage for employees working on the water
-
Coverage of club members, employees and volunteers at no additional premium
-
Coverage for claims alleging sexual molestation
-
Sailing instruction liability
-
Worldwide navigation at no additional premium
-
Pollution coverage (sudden and accidental)
-
Fuel
spill liability
-
Liability from discrimination claims
These
features are not found in standard commercial and marine insurance forms, but
are the hallmark of the Burgee Program™. As yachtsmen and club members, the
specialists at Gowrie Barden & Brett have a unique understanding of the
liabilities that club officers and members face.
For
most yacht club participants responsible drinking is part of the relaxed social
climate of the club. The risks that accompany alcohol shouldn't inhibit us from
fully enjoying the benefits of club membership. The right protection makes all
the difference.

Preserving the Architectural Details
of your Club
Yacht
club clubhouses are a unique and storied lot. With architectural character they
celebrate the traditions of boating, and tangibly portray the history of each
club. Whether elegant or charming, Victorian or Modern, sleek or salty, they
are a club’s biggest asset -- and potentially its biggest liability.
In the
event of a devastating fire, would your current insurance program pay to rebuild
and restore your clubhouse to the way it was? What about the fine architectural
details? Would costs for changes required by building ordinance be incorporated
into the insurance payout, or would members have to be assessed for these
significant costs?
Unfortunately, too many clubs are not fully protected. Even when “replacement
cost” protection is purchased, the building valuation may not incorporate all
the unique architectural details, resulting in underinsurance. After a fire,
when a new building code requires that a club be reconstructed to a higher
standard, many policies do not respond to the “betterment” leave the cost of the
upgrade to the club.
US
SAILING members who insure their yacht clubs through the Burgee Program™ do not
have these concerns. The Burgee Program™ which is offered by yacht club
insurance specialists at Gowrie Barden & Brett and underwritten by the Chubb
Group of Insurance Companies provides true replacement cost for buildings and
upgrades required by building ordinance are covered. The program even offers
the services of professional appraisers who understand the unique
characteristics of historic and marine construction. In the event of a loss,
buildings are restored or rebuilt just as they were prior to the loss. The
Burgee Program™ is a broad insurance plan that correctly values your prized
assets, and offers these additional unique features:
-
Building ordinance and law coverage for building code changes after a loss
-
Debris removal for direct damage loss
-
Jones Act coverage for employees working on the water
-
Coverage of club members, employees and volunteers at no additional premium
-
Liquor liability
-
Coverage for claims alleging sexual molestation
-
Sailing instruction liability
-
Worldwide navigation at no additional premium
-
Pollution coverage (sudden and accidental)
-
Fuel
spill liability
-
Liability from discrimination claims
These
protections are not found in standard commercial and marine insurance forms, but
are the hallmark of the Burgee Program™. As yachtsmen and club members, the
specialists at Gowrie Barden & Brett have a unique understanding of the risks
that yacht clubs face.
For
most of us our clubhouse is a source of pride and offers a deep connection with
the tradition of boating. We need not worry that the legacy embedded in its
style and architecture could vanish. The right protection makes all the
difference.
